MARRIAGE (SPOUSAL) VISAS

In order to bring your foreign national spouse (husband or wife) to live in the United States as a Green Card holder (lawful permanent resident), you must be either a U.S. citizen or Green Card holder.

If you are a US citizen and your foreign national spouse is in the United States through lawful admission or parole, you may be eligible to file a Form I-130 and Form I-485 for your spouse to become a Green Card holder. If you are a US citizen or Green Card holder and your foreign national spouse is overseas, you may be eligible to file a Form I-130 for your spouse to obtain an immigrant visa (green card) at a US consulate or embassy.
